LeRoy man accused of domestic assault, threats – Austin Daily Herald

A LeRoy man has made a first appearance Thursday in a case of domestic assault.

Angel Ismael Herrera, 31, was in Mower County District Court to face a single felony charge of domestic assault and another felony charge of threats of violence stemming from a June 3 incident within the community of LeRoy.

According to the court complaint, the Mower County Sheriff’s Office responded to a home at around 1:40 a.m. in the 79000 block of 115th Street, LeRoy, regarding a 911 hang-up in which a telecommunicator advised that it sounded as if a female was possibly crying on the other end.

A deputy arrived and made contact with the victim who told the deputy that she had been assaulted by her boyfriend. Another deputy arrived and noted blood all over the victim as well an injury to her forehead and bruising to her neck among other injuries. 

The victim said the incident arose from her telling him to stop drinking and Herrera allegedly became upset with her, climbed on top and began choking her, at which point he also allegedly made a threat to kill her.

The victim was eventually able to get away after jabbing a finger into Herrera’s eye, however, after rolling to the ground, Herrera again allegedly started hitting her.

A search of the home failed to turn up Herrera, but he was eventually found sleeping in a vehicle in the garage. When questioned Herrera claimed that they started arguing and that the victim tried grabbing him. 

He went on to say he tried pushing her away and that she hit him in the eye before punching her in order to get her away, denying that he instigated things.

A review of Herrera’s criminal history shows a prior conviction in November of last year for domestic assault-injury of mental illness and assault in certain occupations in March of this year. Both convictions were in Howard County, Iowa.

Herrera’s next appearance will be June 16 for an initial appearance.
