LeRoy man agrees to plea deal regarding Aug. 30 incident involving assault

A LeRoy man charged in September with six counts related to an Aug. 30 incident at a community convenience store agreed to a plea deal Thursday in Mower County District Court.

Nelson Kip Scrivner, 50, agreed to plead guilty to felony third degree car jacking, felony fourth degree assault of a peace officer and misdemeanor fifth degree assault. The remaining charges are to be dismissed as part of the deal.

Scrivner’s sentencing is scheduled for Dec. 18.

Scrivner was accused of assaulting three people during an altercation at the K&H Gas Station early in the evening of Aug. 30, one of which being a juvenile.

According to the court complaint, Mower County Sheriff’s Office deputies were dispatched to the business at around 5:29 p.m. on Aug. 30 for a report of an altercation taking place. A deputy arrived at the scene and witnessed Scrivner crawling away with blood on his shirt. He was ordered to stop several times even as he rose and started to walk away from the deputy, who eventually deployed a Taser with positive results. She also noted the smell of alcohol on his breath.

The complaint goes on to say that Scrivner assaulted the 72-year-old male in his truck at the pumps of the station. The man escaped with the keys and ran to the store where two employees, one of which was the juvenile, tried to get Scrivner to leave. 

During the scuffle Scrivner was accused of putting his hands around the neck of the second male.
